Hard Time Selling Your Commercial Prop? Steal FL-Hawaii Props!!!

Tired of the lengthy process it would take to create a closing for commercial property? How about a faster, simpler, closing solution? One that would allow buyers to approach any cash flowing property and close within 30 days without a loss of capital and at the same time preserve the seller's tax advantages and income.  Introducing the 10-Cap Exchange Network!

So how does it work?

  1. Property Evaluation - A property needs to be eligible for refinance, be listed at somewhere between 60%-65% below Market and cash flowing with a Cap Rate of 10% or better.  (Some rare exceptions may be made.)
  2. Sale Price Evaluation - A price and terms are mutually agreed in writing between you, your attorneys and the investor including the shared 50% of the NOI, tax concessions etc.
  3. Appraisal - An appraisal is ordered to verify the value of the property.  Terms are reevaluated if necessary based on the newest value of the property.  (If the owner already has an appraisal from the last 3 months this will speed up the process.)
  4. Company Restructure - The investor is added to the corporation or one will be formed.
  5. Refinance - The investor will act as co-borrower to refinance the property for up to 80% of the appraised value.
  6. Debt Service - The proceeds from the refinance is used to prepay the debt service one year.
  7. Leveraged Buyout - After six months to one year, you will be removed from the Corporation and the note as agreed.  During that time you are free to reinvest your proceeds or take a vacation while 50% of the property income flows into your bank account.
  8. Tax Time - NO Capital Gains.  PLUS, our investors will allow you to take straight line or accelerated depreciation for your property.  As you know in the case of a hotel, and GoZone Properties this could be as much as 50%.

The beauty is, if your property qualifies, you are as good as free right now.  Because it's a leveraged buyout through refinance, you control the process and the closing. You'll never have to wait on the buyer. Qualified investors will facilitate a quick and successful close.

  

So what about the risk?  What if the investor defaults on the note?

Because the note is prepaid for the year, it will coincide precisely with the agreed timing of the owner's removal from the note.  There will be no possibility for default until after the owner has left the company.

Is this legal?

Yes, and we do encourage you to consult your attorney for advice.  It is important to note that the steps outlined be followed carefully to comply with a refinance.   If a sale is indicated in any way it will change the terms of eligibility significantly.

Why would a Qualified Investor want to do this instead of use cash?

Leverage.  With the 10-Cap Exchange Network, our investors can contract up to 1 property every day because the property is leveraged with the bank for such a short time (6mo.-1yr).  That is a significant increase to their investment portfolio, especially as we begin to see a rise in the market over the next few years.
