    JURY DUTY SCAM

    Posted 10:25 AM November 30, 2011

A popular Scam starts with a telephone Call from a person pretending to be a Jury Official stating an Arrest Warrant has been issued because the person has failed to report for Jury Duty.
Once the person states they reported for Jury Duty, or never received a Jury Questionnaire or Summons, the Scammer requests Personal Information ( Legal Name, Social Security Number, Date Of Birth, Address, etc.) to Purge (cancel) the Warrant.
NEVER provide Personal Information over the Telephone, or your Identity and/or Assets can be stolen.  The PA Court System does not contact people by Telephone to obtain Personal Information.
If you need to Contact the Court, use the Official Published Court Telephone Number.  DO NOT use any telephone number the Scammer provides to gain your Confidence.

AUTO ACCIDENTS, INJURIES, AND TRAFFIC OFFENSES IN PA

    Posted 09:29 PM August 10, 2009

If after an Auto Accident, a person is injured, or there is Property Damage, a Motorist has a legal duty to stop, provide information, render aid and contact the Police. If a Police Accident Investigation is not conducted at the scene, the Motorist must proceed to the nearest Police Station and file a Report .
Should a Motorist fail to stop after being involved in an Accident, or flee the scene, Traffic Citations can be issued, as well as Criminal Charges, with severe Penalties.
A person injured in the Accident may assert a Claim for Money Damages, against a Negligent Party, for Pain, Suffering, Lost Wages, Loss of Personal Property, Mental Anguish, or any Other Loss that is a direct result of the incident. PA TRAFFIC LAW REMINDER

    Posted 09:37 PM June 20, 2009

Pennsylvania Law requires a motorist to turn on the vehicle Head-Lights whenever Windshield-Wipers are needed due to weather conditions. The Head-Lamps must remain illuminated for as long as the Windshield- Wipers are in use.
PA Law provides that any motorist who fails to remove Snow or Ice from thier vehicle, and the debris causes serious bodily injury, or death to another, shall be subject to a Penalty that also includes a $1,000.00 Fine. As a practical matter, the offending motorist may also be subject to a Negligence Lawsuit for money damages, which could be $ubstantial.  Samuel G. Forte, Esquire.  www.fortelawoffices.com

    REAL ESTATE TRANSACTIONS IN PA

    Posted 09:30 PM March 23, 2009

Buying or selling a home, for most people, is one of the largest financial transactions made in thier lifetime. While Real Estate Agents provide a valuable service, they can not under any circumstances provide legal services or advice. To protect your Interests, an Attorney should be hired to negotiate, draft and review all terms and documents on your behalf.
NEVER SIGN ANYTHING UNTIL REVIEWED AND EXPLAINED BY YOUR LAWYER.
    Tip:
A Home Inspector (of your own choosing) should always be hired (by you) to perform a detailed Inspection of the home for problems, defects, etc. Be advised, an Inspection performed by a Mortgage Company is for financial purposes only and is not an adequate Inspection, as the Lender does not evaluate the vital heating and cooling systems, roofing, plumbing, electric service, appliances, fixtures, etc., any of which could change the value of your purchase. Contact the Law Offices for a Free Consultation
General Rule: ALL AGREEMENTS AND UNDERSTANDINGS MUST BE IN WRITING.     www.fortelawoffices.com

    POWER OF ATTORNEY IN PENNSYLVANIA

    Posted 09:04 PM February 17, 2009

Under PA Law, a person who grants thier authority to another to act for them is called a Principal. The person who receives the authority is called an Agent. Changes in the Law now require a Power Of Attorney to be signed by all parties named in the document to be valid. A specific statutory format must be followed or the document will be void in Pennsylvania. Authority can be granted for both financial and medical purposes.
The Power may be cancelled by the Court, the Principal, or Death. Call for a Free Consultation.  www.fortelawoffices.com

    CRIMINAL LAW

    Posted 11:38 PM February 05, 2009

A Criminal Record could cause problems with Employment Opportunities, Housing, Professional Licenses, Insurance, etc., even if the Crime was not "serious" and was only a First (1st) Offense.  However, the Law allows for a Criminal Record to be "Expunged" (deleted or erased), provided the Applicant meets and satisfies certain requirements under the Law. A "Pardon" may also be a possible solution for a qualified Applicant. If an individual is charged with any type of Crime or Offense, an Attorney should be consulted immediately to properly resolve the matter and protect the interests of the accused. NATIONAL DO NOT CALL REGISTRY

    Posted 10:29 PM November 03, 2008

The National Do Not Call Registry is a Federal list which enables a person to register thier telephone number, by dialing 1-888-382-1222, to have their telephone number excluded from telemarketer contact. Each telephone number must be re-registered  every five (5) years to continue exclusion.

If a telemarketer calls a protected telephone number, a Complaint may be filed with the Federal Trade Commission, and a successful prosecution could cost the telemarketer thousands of dollars in penalties. Enjoy the quiet. For a Free Consultation contact the Law Offices Of  Samuel G. DON'T IGNORE TRAFFIC CITATIONS

    Posted 09:36 PM October 27, 2008

Whenever a motorist receives a Traffic Citation, prompt attention is required, or severe penalties may be impose, which could include license suspension, fines, vehicle impound and even jail.  Traffic Offenses should be carefully reviewed and resolved either by prompt payment, or Court challenge. Be advised, that points assessed against a Driver's License can substantially raise insurance rates, and also result in a suspension of driving privileges. Often, a Court challenge is worth the effort, as a more just result may be possible. Never ignore a Traffic Citation, as the fines, costs and penalties can quickly escalate. www.fortelawoffices.com

    DEATH and PROBATE

    Posted 12:07 AM September 17, 2008

When a person dies, Legal Procedures are often required to properly settle the dead person's Estate. The process is called Estate Administration, which is governed by Federal, State and Local  Laws.  Estate Administration includes many responsibilities, including: Asset collection, transfer or sale of the Assets; paying the debts and liabilities of the deceased: filing the Estate Documents and Tax Return(s); distributing the Estate property to the hiers, etc.  There is often much to do to comply with the Law even for a relatively small Estate.  The guidance of a Lawyer is always prudent in these matters.
