The landlord, management company, and/or owner must make sure the rental property is "habitable." The unfortunate part is, each state has its own views on habitability. Have the mold tested before going to seek legal advice. It is better than just documentation.

If you need a lawyer, then make sure they do their own testing and property inspection. It may cost more in the beginning, but a secondary documentation and analysis is wise.
