How Does a Personal Injury Claim Work?

About a Personal Injury Claim

Personal injury claims are filed everyday by people involved in accidents and victims of assault. There are many lawyers that will take on a personal injury case provided the injury is severe enough to warrant a large compensation from the court.

Facts

A personal injury claim is the legal term for injuries to a person as opposed to injury of an object such as a car or house. Some common types of personal injury claims are assault, work accidents, at home accidents and traffic accidents. In many cases, if the injured party has proof the defendant was negligent, they will receive monetary compensation.

The Compensation Value of a Personal Injury Claim

When it comes time for the court to determine the amount of compensation the victim will receive, there are several things to be taken into consideration. The first thing is liability. If there is not a clear victim and defendant in the case it is much harder to win a personal injury claim. The second thing taken into consideration is the type of injury the victim received. Any victim with a major injury is advised to have a lawyer represent them in court. If the injury is minor, many times the victim will represent himself or herself. The third thing taken into consideration is the age of the victim. Generally, the younger the victim is the more money they are entitled to. People over the age of 60 have a better chance of getting a large amount of money because jurors will often feel sorry for them.
