How to Change an Irrevocable Trusts
An irrevocable trust is normally something that you cannot make a change to, which is why they are termed “irrevocable.” There are trusts that can be changed at any time, but they are termed “revocable.” Nonetheless, there are ways around this.
The best way to have an irrevocable trust changed is to convince the trust protector that the change is necessary. A trust protector is an independent third party who is hired to oversee the trust. If he thinks that a change should be made, he can either make the change on his own or ask a judge to make the change for him.
- Contact your trust protector. Since he is the one who oversees the trust, your first step to getting a change will be to contact him about your wishes.
- Discuss with him the change you are seeking and why you think it is necessary. You need to convince him that the change is warranted, in order to get him to do what is necessary to get the change made.
- Ask the trust protector to sign any documents needed to make the change himself. In some situations, the trust protector may not be able to make the change on his own, but instead must ask a judge to make the change. In this situation, the trust protector will have to convince the judge that the change is necessary, just as you convinced the trust protector that the change is necessary.
