How to Create a Separation Agreement
Separation documents are usually something to be completes before a divorce takes place. The goal of these documents is to prevent divorces from being overly long and complicated. Some people find that they are hard to create; therefore it is best to follow a few guidelines.
- Designate ther persons involved using the terms "the husband" and "the wife" rahter than using your actual names. This will keep the document clear and easy to read, and will continue throughout the entire separation document.
- State the basic details of the marriage, such as the date of marriage and the length of the relationship. You should also include why the husband and wife have decided to separate.
- State which partner will be in charge of any remaining bills, and include information if one of the partners is planning to move out of the home state.
- Decide on plans for any existing children and include this information in the document. Plans would include custody agreements, living arrangements and travel plans if one of the parents will be out of state.
- Detail the distribution of any shared possessions or property.
- Include any issues that the couple cannot solve out amongst themselves at the end of the document; these can be addressed in court. However, it should be noted that it is best to agree about as much as possible prior to going to court, as that will make the divorce process much smoother and expedient.
