How to Get an Order of Protection

How to Defend Against an Order of Protection

A court order of protection is filed in a court due to a complaint against another person. Many times these orders are not approved when the petitioner cannot prove that an illegal crime was committed against them. There is a way to defend against an order of protection.

  1. Carefully review all documents that were issued from the petitioner. These documents will likely have the complaints made against the plaintiff. This will provide useful information to help prepare a defense. The more detailed the complaint is, the easier it will be to defend against it.

  2. Stay away from the person who is filing the complaint or seeking the order, called the petitioner. This person will more than likely use this to add to the complaint issues. It is best not to have any contact with this person until the case is settled.

  3. Gather all necessary documents to prove that this order is not required, and that no laws were broken. It is up to the plaintiff to defend themselves against any claims that the petitioner has against him or her. Sometimes these cases can be handled without the use of an attorney, but it is always wise to seek legal advice when this situation arises.

  4. Recruit witnesses that can help defend against the order of protection. The more witnesses that a person can gather who can give reputable testimony will be best.

  5. Dress in a very professional manner when going to court. This shows respect for the court as well as the judges. Business attire will work best for men or women, and it is important to conduct oneself in a professional manner.

  6. Bring all of the evidence that will support the defense to the court date hearing that has been set for the order of protection. It is important that the plaintiff remain as calm as possible throughout the hearing.
