How to File Chapter 7 Bankruptcy Forms & Preparation
The most common type of bankruptcy is Chapter 7 bankruptcy. This will offer you a fresh start by getting rid of almost all of your debt. Businesses can also file Chapter 7 bankruptcy, which will result in the termination of the business while releasing the owner from any outstanding debt. If this is something you are considering doing, you will want to know how to file the appropriate forms.
- Businesses must hire an attorney to represent them. However, individuals can represent themselves.
- Look for your local District Bankruptcy Court’s information. Contact them to find out where you must go to file for bankruptcy. This information can be found online or within your local directory.
- Purchase the “Nolo Guide” from your local bookstore. This will serve as a good legal reference manual to walk you through the steps that you must take in order to file Chapter 7 bankruptcy.
- You will be required to take a credit-counseling course from an approved credit-counseling agency before being allowed to file for Chapter 7 bankruptcy. Your local District Bankruptcy Court will be able to refer you to such an agency.
- Go to the U.S. Bankruptcy Court’s website to download and print out a copy of the Voluntary Petition. You will need to fill this out after you have done your credit-counseling course. Once it is filled out you will need to file it in your state’s U.S. District Bankruptcy Court.
