How to File a Medical Claim After a Personal Injury Accident

When you are injured in an accident where the other driver is at fault you should file a medical claim. This medical claim provides the other driver's insurance carrier of all expenses you have incurred during treatment of your injury. It is through this medical claim that your providers are paid when you are not at fault.

  1. Request a copy of the accident report from the law enforcement agency that reported the accident. Generally you show the clerk your driver's license upon request. The clerk searches the database for these documents and prints out an official report.

  2. Request copies of all records pertaining to medical treatment for this injury. If you were sent to the emergency room via ambulance request a copy of any records pertaining to treatment received from ambulance personnel and from the emergency room.

  3. Visit your primary and/or private physician. Usually the emergency doctor unless you received some form of surgery will inform to visit your primary physician within a specific amount of time following an accident.

  4. Request copies of medical records from your primary and/or private physician.

  5. Compile copies of all bills related to this injury if you have received these bills.

  6. Provide your auto insurance carrier with copies of the record you gathered in steps 1 through 5. Your auto insurance agent has the required forms to file a medical claim with the other driver's auto insurance provider. The paperwork along with copies of your medical records and bills are sent with this claim. Once the claim is filed there is a waiting period before you collect any money. Your auto insurance agent could provide you with an approximate date.
