How to Give Medical Power of Attorney

A medical power of attorney is a legal document that assigns an agent to make critical medical decisions when someone is incompetent for any reason.  The agent needs to be completely trustworthy to make such important decisions.  You do not need a lawyer to give medical power of attorney, but you need to fill out a form and follow certain requirements.

  1. Contact your local hospital or other health care provider to request a medical power of attorney form.  You can also get this from an attorney or a state health association, and there are many available to download online.

  2. Arrange for two witnesses to be present when signing of the document.  One must be of no relation to you, your physician, affiliated with your medical facility, or an heir or have a claim to your estate.

  3. Sign the medical power of attorney document in the presence of a notary public.  This validates the signatures of you and your witnesses and is the best legal protection.

  4. File the medical power of attorney with your health care provider and keep a copy somewhere safe.  Most importantly, the agent acting on your behalf must have a copy, as well.

  • A medical power of attorney can be of great help when you are gravely injured or otherwise unable to make decisions.  Someone you find trustworthy and cares about your well-being will be able to make those judgements in the same way you would.  Be sure to set clear expectations to help guide your agent if the time comes to choose your health care options.
