How to Prepare Records for Medical Litigation
Medical litigation procedures are most commonly undertaken when some kind of medical malpractice has been performed. Having a properly documented case is imperative if you wish to win your lawsuit. Learn how to prepare records for medical litigation so that you will be armed with the evidence that will prove your claim.
- Gather your medical history. A complete listing of your medical history proceeding as far into the past as possible should be the first item included in your records. You can often request the medical records by phone or via written letter. The records should include the names of your physicians, date and times of office visits, the diagnosis that each doctor administered, and all medications prescribed. Be sure that the initial complaints made to your doctor in reference to the medical lawsuit you are currently pursuing are properly documented.
- Create a timeline. Once you have your records in hand, create a timeline that pivots on the first doctor's office visit which has a clearly documented complaint that is pertinent to your case. Your records should be labeled "pre-medical condition" and "post-medical condition." This will make it easier for your attorney to prove that the issue did not exist prior to the malpractice or negligence that was rendered by the defendant.
- Prepare a medical summary. A medical summary ties together the components of your medical history in a way which outlines how your life has changed as a result of the defendant's actions. Include your daily routine, medications and the limitations your medical condition places on you. Be concise and include only the facts, leaving out any embellishments which could hinder credibility.
