How to Win a DUI Case

Winning a DUI case isn’t easy. In most cases you need to be able to prove there were extraordinary circumstances or severe misconduct with the way the arrest was handled. However, with a good lawyer you may be able to win a DUI case. If nothing else you can usually plea these cases down to less serious charges.

It’s possible to win a DUI case. You’ll need an excellent attorney to try this. Be prepared to plea it down to a lesser charge instead of winning; many states are starting to crack down on DUI charges, and it may not be possible to have it dropped entirely.

  • Find an attorney that specializes in DUI cases. While most attorneys who deal with traffic citations will handle a DUI case, you want a lawyer that has a record of fighting and winning. They may be expensive, but if you want to avoid having a drunk driving charge on your record, it’s well worth the money.

  • Get a copy of the original police report. You want to do this as soon as you can. Go over the report and see if it matches your recollection of the events. If anything doesn’t match from your perspective jot down the discrepancies. Your attorney will need that information.

  • Ask your lawyer about the laws surrounding the blood alcohol or breathalyzer test. Some states give you the right to have your own doctor perform the test, while others aren’t this lenient. You may be able to challenge the results of the test, so it’s important to get copies of these records as well.

  • Find out why you were stopped to begin with. The 4th Amendment prohibits searches for unreasonable offenses. The police need a reason to pull you over before they even test your sobriety. If you feel you were stopped for unreasonable actions, you need to tell your attorney. He may be able to challenge the case based on this.
