Reasons to Cancel a Pest Control Agreement
When you have a pest control agreement, it is a binding contract. However, there some reasons that you may need to cancel your agreement. Most often times, the agreement is canceled because the pest problem has been taken care of or because of health issues.
- Breach of Contract- Because your contract with the pest control company is legal and binding, any party that does not fulfill their end of the agreement is in breach of the contract. For instance, if you are supposed to receive pest control treatments every month and the company doesn't show to do the treatment then you don't have to continue to pay for the service. In order to stand up in court, the judge must deem this a material breach. Sufficient time must also be given by both parties as to the date of service to be considered breach.
- Fraud- If the pest control company signs a fraudulent agreement, then you can legally rescind your end of the contract without any penalties. Fraudulent contracts could include the pest control company claiming they can provide you with a service they cannot perform or tricking a mentally incapable person into signing a contract when they do not understand the terms is considered fraudulent.
- Health Problems- Legally, the pest control company has to use materials that are approved by the EPA as well as the USDA. This means that anything they use will not harm anything other than its intended purpose. These chemicals can cause health problems due to allergies as well as the overall harsh nature of the chemicals. If you start to experience health issues that were not present previous to hiring the pest control company, go to a doctor and get checked out. If the doctor determines the chemicals being used are causing you to be ill, this is a valid reason for a pest control contract to be terminated.
- Consumer Laws- the Federal Trade Commission has mandated that there be a cooling-off period for any contract. This often gives the consumer up to thirty days to cancel the service for no legal reason. This helps prevent people from being roped into rash decisions that are made in the heat of the moment while under pressure. These consumer laws are not applicable to every contract signed, however do cover door-to-door sales that include pest control.
