How Does a Restraining Order Work?

Three Reasons to Update Legal Research

Proper legal research is one of many important services performed by lawyers and paralegals in representing clients and preparing legal documents. It can be the deciding factor in winning or losing a lawsuit. Pertinent information can be found easily since much of it is already available on the Internet. Learn three of the important reasons to perform an update.

Pending Cases Are Decided

An attorney must research the newest decisions in cases similar to his client's case to verify they continue to support current work. If the newest rulings are favorable and reflective of current law, the attorney could add these cases to the pleading before filing. On the other hand, if he finds these now go against the initial research already concluded, he must ascertain if there are possible new directions to take. If there are, he carefully crafts and incorporates new language. It is possible he will need to advise the client to drop the case if there are no new directions available.

Appeals Courts Overrule Previous Rulings

Unfavorable decisions are often taken to a higher authority for review. If an appeals court agrees that serious mistakes were made at a lower court level, previous rulings can be overturned. When weighty circumstances are involved such as a large loss of money or privilege, it is quite common that an appeal will be filed if the evidence supports it.

Other Changes Have Occurred

Updated legal research for such items as new federal, state and local laws, rules, statutes and regulations shortly before filing a legal document gives assurance they continue to support a client's request and best interest. Failure to do so can result in an unfavorable outcome. This failure can also result in unnecessary expenditures of costs and fees.
