What Are the Regulations on Housing Associations?
Housing Association regulations are mandated by each state, individually. The Association is a nonprofit organization that offers housing to a certain demographic. A housing association can also be formed by a group of people looking to maintain order and upkeep of a particular area of homes, such as a subdivision. Other areas of people may look toward the Housing Association for assistance with housing for low-income.
Non Profit Guidelines
There are laws involved in just about everything. If a non-profit organization is formed, there are state laws that must be followed while operating the business. A majority of the non-profit organizations receive funding assistance through various government entities. Constant reports must be maintained that detail finances, operation, and other factors that involve the running of the association.
Bylaws can and should be written with each association that include responsibilities, procedures, and all other duties.
Tax Exemption
The Internal Revenue Service (IRS) must be informed of a housing association’s existence. The directors of the association must provide a 501 (c)(3) application to the IRS to receive tax-exemption status, due to the non-profit status. Annual reports are required to be submitted to the IRS; some states require registration through other government agencies.
Statutes
Each state has their own set of statutes that are in place for housing associations. The statutes are laws that provide a particular guideline to follow; guideline will vary from state to state. The rules that are in place can either minimize the rules in certain situations or require stricter demands.
Regulations cover all matters that are associated with maintaining the operation of a housing association on a daily basis. The regulations are in place for all employees and members of the association; different procedures are included in the regulations, as well as financial reporting.
