What is a Car Accident Witness Report?

A car accident witness statement can be useful in disputed claims.  It is usually written by the responding police officer or eyewitness. If the statement isn't written personally, it is important to read over the given statement for any mistakes because there is a high chance of witnesses being called to court.


 


  • In a car accident claim, it can be advantageous to have a witness statement. You can prove fault and if there are injuries and/or damages, they were the direct result of the car accident. 

  • The witness statement must be made immediately following the accident, or a short time afterwards.  Details will be reflected more accurately when it is still fresh in the mind.  The statement must also be made in response to an official inquiry. While not all statements need to be requested, a report made because the witness desires to make an assertion can be admissible in court.

  • You must show your insurance company that the report is reliable.  Provide all information, such as date of accident, name of witness, and that witness was used by police in creating an accident report.  If there is any relationship that would hinder or enhance the investigation, this should be disclosed as well.  A car accident report from a stranger, rather than your mom, seems more reliable in the eyes of your insurance company.
