How to Avoid Sex Discrimination

Sexual discrimination makes up a high number of lawsuits filed in the United States. For this reason you as an employer need to educate your staff and/or human resources department of the many actions that constitute sexual discrimination. By following the required federal guidelines you do not leave your organization open to a possible lawsuit.

  • Refrain from adjusting offering salary once you hire an individual of a different gender for a specific job. If you are offering one salary for a man you should offer the same salary for a woman. Do not change a salary amount once you have officially hired an individual that is of a different gender.

  • Ensure that all employees are aware of your sexual harassment policies and enforce these policies. Do not give upper management a free pass when an employee reports a sexual harassment related incident that involves your senior management. Handle all reports without bias and/or prejudice.

  • Ensure that all employees both male and female have the same opportunities within your company. Do not offer advancement to only one gender. Allow both genders to have the opportunity to become management. Do not overlook women that have applied for upper management positions simply due to their gender.

  • Ensure that the rules of your organization apply to everyone. Do not enforce a dress code that is female specific only for example. If you have such rules they should also apply to men.

  • Do not make exceptions for only one gender. Do not overlook behaviors that affect job duties. For example, if an employee or group of employees is harassing others due to their gender you are required to take action.
