How to Sue for Medical Malpractice

Medical malpractice is a serious accusation. If you or a loved one find that you have been irreparably damaged by a medical practitioner's actions, you may find it necessary to sue him for medical malpractice. These types of cases are emotionally and financially draining, so you should be prepared for a difficult case from the outset.

  1. Compile all of the evidence you have that proves the medical practitioner in question did harm. This can be physical, emotional or financial harm that you or someone close to you has suffered.

  2. Determine whether your medical practitioner in question performed services incorrectly or negligently. Determine also whether the harm was caused by the medical practitioner himself, or by a policy enacted by the hospital or healthcare center in which the patient was seen. This can change your case dramatically depending on the circumstances.

  3. Contact a medical malpractice attorney for assistance. This is an attorney who specializes in medical cases. Since medical malpractice laws are extremely complicated, you should not proceed without an attorney to look at all of the facts for you.

  4. Answer all of your attorney's questions and obtain any additional proof that is required in order to bolster your case. Your attorney will file the proper paperwork to begin your malpractice suit once all of the evidence has been gathered. You or the affected individual will likely have to testify at the proceedings as to how the medical practitioner's actions caused harm. These types of cases can drag on for years depending on the amount of damages sought and the complexity of the case itself.
