Sexual Harassment Training Regulations

Sexual harassment training is important because it prepares the employer and supervisors on what to do and how to handle sexual harassment if it arises on the job. Supervisors in the workplace are required to undergo periodic sexual harassment training. There are certain sexual harassment training regulations that employers must abide by.

Amount

Every couple of years an employer is required to give everyone who is in a supervisory role, two hours of training once every couple of years. The training can either be done in a classroom setting or over the Internet as a webinar. Although the training does not have to be done for two consecutive hours, the minimum amount of time for training is 30 minutes.

Content

Training should include information, such as a definition of sexual harassment, explanation of the types of behavior that would be considered a sexual harassment, ways to prevent harassment, and how harassment can be remedied. The employer's is obligated to conduct investigations of harassment complaints and know what to do if an incident occurs where a supervisor is personally accused of sexual harassment.

Compliance

There are two different ways that an employer can track employee's compliance to make sure that it is in compliance with the required training. One is to do "individual" tracking, in which each supervisory employee has to undergo training within two years from the last date that they were trained. The second option is "training year" tracking, in which the employer can designate a specific year to be a "training year" where all the supervisory employees are all trained. They would then be retrained two years later, which is by the end of the designated training year.

Documentation

All employers must keep some type of documentation on file of the training that they have proved to its employees. The documentation must at include the name of the trainee, the name of the trainer, and the type and date of the training that was done. This documentation must be kept on file for at least two years.
