The Professional Process Server

The Process Server is the first link in the legal chain for the which the legal process may begin.  It is never pleasant, but if the Process Server is professional, it is at least more than tolerable.  The first step for the Process Server is to PROPERLY identify him/herself to the subject being served and to state what it is the subject is being served with. It is not a bad idea to ask the subject to produce identification.  This is not a legal requirement but if the Process Server is professional and produces his./her own Creditials from his serice.  This company issues each agent with proper identificaiton. pictured and authorized.   Each agent also wears a uniform. It provides the Process Server with a sense of safety as he/she is readily identifiable and presents an air of authority. The second step is actually a continuation of the first. The Process Server should record the time, date, person served, location of the service, and a complete description of the person you serve. Third step is to attempt to leave the subject at ease.  This is not always easy. The person is going to have questions. The process server is not a lawyer and must not give legal advice. If asked to give a legal opinion, the Process Server MUST tel the subject that he is not permitted to give legal advice and if the person feels it is necessary, the subject should seek good, competent legal avice. Fourth, it to prepare a good professional affidavit of service which is legally adequate to prove the service. A proper affidavit is one that details  the exact method of service, specifing who, what when where how.  There is a preprinted form that can be used but it is not really adquate in my opinion. While legally sufficient is it assailable and may be contested in court. The affidavits of this company are very very specific as to the method of service, how the Process Server knew he was sering the right person and a complete description including the clothing worn by the person served. This company stresses PROFESSIONALISM, PROFESSIONALISM, PROFESSIONALISM. Walter E. Beverly, III Chief of Service
